Castles is a Software-as-a-Service (SaaS) platform that provides a structured memory layer and knowledge management system designed for enterprise AI and large language model (LLM) workflows. Our platform integrates with your infrastructure via the Model Context Protocol (MCP), enabling organizations to build persistent, contextual knowledge bases that enhance the accuracy and consistency of AI-driven decision-making and automation.

3. Account Registration and Responsibility

To use Castles, you may be required to create an account. When you register, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the confidentiality of your login credentials
• Accept full responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breaches
• Be at least 18 years old (or have parental consent if under 18)

You acknowledge that you are responsible for all actions taken through your account and agree to keep your password secure at all times.

4. Subscription and Billing

Castles offers three subscription tiers:

• Starter: For individual developers and small teams evaluating Castles
• Growth: For established teams and departments requiring expanded capacity and features
• Enterprise: For large-scale deployments with custom requirements and dedicated support

Subscription terms include:

• Auto-renewal: Your subscription will automatically renew at the end of each billing period unless you cancel in advance
• Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and no refunds are provided for partial months
• Price changes: We may adjust subscription prices with 30 days' prior written notice. Continued use of Castles after the notice period constitutes acceptance of the new price
• Payment: You authorize us to charge your payment method for all fees due under your subscription plan

5. Lead Capture and Marketing Communications

When you submit forms on our website, we collect contact information including your name, email address, and company details for two primary purposes:

• To respond to your inquiry or request for information
• To send you marketing communications about Castles products, features, updates, and related offers

• Involves any form of spamming, phishing, or social engineering

Violation of these acceptable use policies may result in immediate suspension or termination of your account without refund.

7. Intellectual Property

Castles platform IP: All intellectual property rights in the Castles platform, including its design, functionality, technology, code, documentation, and content, are owned by Castles and its licensors. You are granted a limited, non-exclusive, non-transferable license to use Castles for your internal business purposes only.

Your content: You retain full ownership of any content, data, documents, or other materials you upload to, create within, or submit through Castles ("Your Content"). By uploading Your Content, you grant Castles a worldwide, royalty-free, non-exclusive license to use, store, and process Your Content solely for the purpose of providing the Castles service to you.

You represent and warrant that you own or have the necessary rights to all Your Content and that its use does not violate any third-party rights or applicable laws.

8. Data Protection and Privacy

Your privacy is important to us. For detailed information about how we collect, use, process, and protect your personal data, please refer to our Privacy Policy.

Castles processes personal data in accordance with all applicable data protection laws, including but not limited to the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other relevant regulations in your jurisdiction. 9. Limitation of Liability

As-is service: Castles is provided "as is" and "as available" without warranties of any kind, either express or implied. We make no representations regarding the accuracy, reliability, completeness, or suitability of our platform for your specific needs.

Service availability: We make reasonable efforts to maintain the availability and performance of Castles, but we do not guarantee uninterrupted or error-free service. Temporary outages for maintenance, updates, or emergency repairs may occur.

Liability cap: To the fullest extent permitted by law, Castles and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of or inability to use the service, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or your use of Castles shall not exceed the amount you have paid to us in the 12 months preceding the claim.

10. Termination

Termination by you: You may terminate your account and subscription at any time by contacting us or using your account settings. Upon termination, your access to Castles will cease immediately.

Termination by Castles: We may suspend or terminate your account immediately if you violate these terms, engage in unlawful activity, or pose a threat to our systems or other users.

Data upon termination: Upon termination of your account, we will retain Your Content for a period of 30 days to allow you to retrieve it. After this period, Your Content will be permanently deleted from our systems and cannot be recovered. You are responsible for maintaining backups of any important data before account termination.

11. Changes to These Terms

Castles reserves the right to update, modify, or change these Terms and Conditions at any time. If we make material changes, we will provide notice by updating the "Last updated" date at the top of this page and, where appropriate, by sending you an email notification or prominent notice on our website.

Your continued use of Castles following the posting of revised terms means that you accept and agree to the changes. If you do not agree to the revised terms, you must discontinue your use of Castles.

12. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. The parties consent to the exclusive jurisdiction of the courts located in Australia.

However, we acknowledge and respect the consumer protection rights of users in all jurisdictions. If you are a consumer in a jurisdiction with mandatory consumer protection laws, those laws shall apply to the extent they are more protective than these terms, and we will comply with all applicable local consumer protection regulations.
